Terms and Conditions of Domain Registration Service

The terms and conditions presented below apply to the domain registration service provided by PUQ sp. z o.o. (hereinafter referred to as PUQ) and are effective as of March 22, 2024, replacing any previous terms and conditions regarding this service.

  1. The service provider offers services consisting of mediating in domain registration, including their administrative and technical management.
  2. The service recipient places an order to use the domain registration service during Registration using the Form or later on - using the Service Recipient's Account.
  3. The domain registration service will be performed after the Service Provider receives the payment for the applicable Fee, which is then transferred to the account of the respective domain registrar upon receipt by the Service Provider. The price of domain registration/update service is specified in the Price List.
  4. The domain is registered by the Service Provider on behalf of the Service Recipient - the subscriber of the internet domain.
  5. The process of registering the internet domain will be initiated by the Service Provider upon receipt of payment for the applicable Fee.
  6. The domain registration service is provided for a fee under the terms specified by the Service Provider when placing an order for the provision of domain registration service and according to the Price specified in the Price List.
  7. As part of the domain registration service, the Service Recipient instructs the Service Provider to register the domain on behalf of and for the Service Recipient, including representing them before the Registrar in connection with the performance of the Service.
  8. The Service Recipient consents to the Service Provider providing the relevant Registrar with the personal data of the Service Recipient, in order for the Service Provider to perform the domain registration service and in the necessary scope for this purpose.
  9. The Registrar for individual top-level domains are Internet Domain Service BS Corp., Ocean Cenre, Montagu Foreshore, East Bay Street Nassau, New Providence, The Bahamas, and CentralNic Group PLC, a company registered in England & Wales with Registration Number 08576358, Address: 4th Floor, Saddlers House, 44 Gutter Lane, London, EC2V 6BR https://internetbs.net/  and Consulting Service Sp. z o.o., ul.   10. The Service Recipient declares that they have read and unconditionally accept the terms of registration of individual domains available on the Registrar's website indicated above.
  11. The Service Recipient acknowledges and accepts that the Service Provider is not responsible if:
    1. the domain name chosen by the Service Recipient is already registered or reserved,
    2. registration proceedings for the chosen domain have already been initiated,
    3. the domain cannot be registered due to registration conditions for the specific domain accepted by the Registrar, as referred to in item 10 above,
    4. the Service Recipient has provided incorrect domain name or personal data of the Service Recipient, which are incomplete or untrue, preventing registration,
    5. the application for domain registration contains missing information (is incomplete) or contains false information,
    6. domain registration is impossible for reasons other than those listed in this paragraph, which are not dependent on the Service Provider.
  12. In the event of inability to register the domain, the Service Recipient is entitled to a refund of the paid Fee.
  13. The Service Provider will inform the Service Recipient about the registration of the ordered domain and about the acceptance by the Service Provider of the administrative and technical management of the domain transferred to the Service Provider.
  14. The Service Provider is not liable for:
    1. blocking, takeover, or deletion of the domain due to the Service Recipient's arrears or lack of payments to the Service Provider,
    2. domain registration in bad faith,
    3. loss of rights to the domain by the Service Recipient as a result of third-party claims to the registered domain and resolution of these claims in accordance with applicable law or the provisions of domain registration terms referred to in item 10 above,
    4. changes in the domain configuration, deletion of the domain by an unauthorized entity in case of loss by the Service Recipient of access data to the Account.
  15. The Service Provider registers domains for a specified period, not less than 1 year (hereinafter referred to as the Domain Validity Period). The domain validity period is specified each time when placing an order for domain registration.
  16. The Service Provider undertakes to provide, upon each request of the Service Recipient, the data authorizing access to the domain and enabling the Service Recipient to transfer the domain to another service provider (hereinafter referred to as Authinfo). To obtain the Authinfo code, the Service Recipient should complete the "AUTH-INFO CODE REQUEST" form available on the Registrar's website (https://faq.internetbs.net/hc/en-gb/articles/4509188714397-Auth-code-request). The original application form along with necessary attachments should be sent by post to the Registrar's address: 4th Floor, Saddlers House, 44 Gutter Lane, London, EC2V 6BR (https://internetbs.net/en/contact.html).
  17. The transfer of the domain from another service provider to the Service Provider is free of charge unless otherwise specified in the Price List. The Service Provider provides administrative and technical support for transferred domains in the same manner as for domains registered by the Service Provider. In the case of transferring the domain to the Service Provider, the Service Recipient declares that the domain subscriber data is identical to their personal data. The transfer of some domains may require the Service Recipient to pay the Fee for the registration of the transferred domain for the next Domain Validity Period, which will be added to the existing Domain Validity Period resulting from the domain registration with the previous service provider.
  18. Extending the Domain Validity Period involves continuing the administrative and technical management of the domain by the Service Provider and recording the change of the period for which the domain is registered in the DNS system database. Extending the Domain Validity Period is subject to a fee according to the Price List. The Service Provider is not liable to the Service Recipient for not extending the Domain Validity Period if the Fee for extending the Domain Validity Period has not been credited to the Service Provider's bank account at least 24 hours before the end of the Domain Validity Period or if the Service Recipient has not fulfilled other required actions for extending the Domain Validity Period as specified in the Regulations or conditions referred to in item 10 above.
  19. The Service Recipient has full right to dispose of the registered domain under the conditions specified in the Regulations and in accordance with the conditions referred to in item 10 above.
  20. The Service Recipient may notify the Service Provider of the intention to transfer the rights to the domain resulting from the agreement concluded with the Service Provider to a third party.
  21. In matters not regulated in the Regulations concerning domain registration, the provisions of the regulations of the relevant entities registering domains apply. Internetbs.net: https://internetbs.net/en/termsandconditions.html 
  22. PUQ reserves the right to make changes to the Regulations at any time, provided that these changes do not affect the rights acquired by customers before the changes are introduced.
  23. Each change to the Regulations will be published on the PUQ website. The Customer is obliged to regularly review the content of the Regulations in order to track any changes.
  24. In case of any misunderstandings or disputes between the company and its customers, the parties will seek to resolve them through negotiation and agreement. In the absence of an agreement, the dispute will be resolved by the competent court.
  25. The Regulations come into force upon their publication on the PUQ website and are effective until changed or revoked by the company.
  26. In matters not regulated in these regulations, the relevant provisions of the law apply.
